7/15/2024 – Nathaly Gomez, Arianna Gomez, and Guillarmo Gomez v. NYCHA and Otis Jones:
Plaintiff Nathaly Gomez sought damages for personal injuries arising from Defendants rear-ending their vehicle. Defendants answered and filed a counterclaim against Nathaly Gomez. Our office appeared to defend against the counterclaim. Brian Massey and Guang Xiong Li argued that a rear-end accident creates a presumption of negligence on the part of the driver of the rear vehicle. NYCHA argued that Nathaly Gomez stopped short. Justice Gouldborne agreed with our arguments and further found NYCHA’s allegations were insufficient to rebut the presumption of negligence. As a result, NYCHA’s counterclaim was dismissed.
