FameFlynet, Inc. v. Jasmine Enterprises Incorporated.
Plaintiff commenced an action in the United States District Court of the Southern District of New York alleging copyright infringement as against our client, Jasmine Enterprises Incorporated, an Illinois based company. James Walsh successfully moved to transfer the action to the United States District Court of the Northern District of Illinois on the basis that the plaintiff, a California company, did not have any connection to the State of New York other than its chosen law firm which was based in Nassau County, New York. The Court determined that the plaintiff was not owed deference to its choice of forum and found that factors weighed in favor of transfer to the Northern District of Illinois.
