Summary Judgment – Queens County
12/16/2008
Rabines v. Power Cooling, Inc. and William Lewis
In Rabines v. Power Cooling, Inc. & William Lewis, plaintiff Vanessa Rabines alleged that our client William Lewis, who was operating a van owned by his employer and our other client, Power Cooling, Inc., struck her vehicle as the intersection of 23rd Street and 30th Avenue in Astoria, New York. Plaintiff allegedly sustained injuries to her neck, back and right shoulder. Prior to trial, Peter Lo Palo moved for summary judgment, arguing that Vanessa Rabines’ injuries failed to meet the “serious injury threshold” as defined by Section 5102(d) of the Insurance Law of the State of New York. The Court agreed and dismissed plaintiff’s complaint.
