Bradley v. 202 Beach 30th Corporation and Plaza Contracting Company
In Bradley, the plaintiff tripped and fell down an exterior stairway at 202 Beach 30th Street, in Far Rockaway, New York. Our client, Plaza Contracting Company, performed repair work on the staircase. Plaintiff alleged that the subject repairs were negligently performed by Plaza creating a hazardous condition. Upon the close of discovery, CMM moved for summary judgment arguing that the repairs performed by Plaza did not create a hazardous condition–nor were they the proximate cause of plaintiff’s accident. The court agreed and dismissed all claims and cross-claims against Plaza.
