Patricia Zukovich v. Harrah’s Atlantic City
The plaintiff, Patricia Zukovich, alleged that she tripped and fell when walking on the main concourse at Harrah’s Casino due to a raised and uneven metal stripping that separated the marble from inlaid carpeting. When plaintiff tripped she fell forward violently striking her head on a brass handrail. As a result, she suffered a closed head injury and severe facial scarring. Notably, the accident was captured by surveillance cameras.
At the close of discovery, Reena Shah moved for summary judgment arguing that there was no proof that there was a dangerous condition or that this alleged condition was the proximate cause of plaintiff’s fall. She also argued there was no proof that Harrah’s had actual or constructive notice of the purported condition. Judge Rothstadt agreed and granted Ms. Shah’s motion.
