Enrique Ali v. 500 Fifth Avenue
Plaintiff Ali was an asbestos abatement worker who was electrocuted and thrown from a Baker scaffold while removing asbestos from the basement ceiling of 500 Fifth Avenue. As a result of the accident, plaintiff fractured his thoracic spine.
At the close of discovery, Joseph O. Tuffy, relying on deposition testimony and voluminous documentation moved for summary judgment. Mr. Tuffy was able to successfully demonstrate to Judge Louis York that our client, Atlas Acon Electric Service Corp., although the buildings electricians, had no involvement in “safing off” the electricity in the basement prior to plaintiff commencing asbestos work. Thus, the motion was granted and the case dismissed against our client.
