Trumboli v. 5th Avenue Paving, Inc. et al.
In Trumboli v. 5th Avenue Paving, Inc. et al. plaintiff was caused to trip and fall due to an alleged dip in the parking lot at the Gateway Motor Inn located at 1780 Sunrise Highway in Merrick, New York. The property was owned and operated by co-defendants. Our clients resurfaced the parking lot several years prior to the date of incident. Peter LoPalo argued that plaintiff failed to establish that our clients created a dangerous condition or had notice of one. The Court agreed and plaintiff’s complaint, along with all cross-claims, were dismissed against our clients.
