Doney v. Harrah’s Casino
In Doney, plaintiff slipped and fell on the marble concourse at Harrah’s Casino. Plaintiff alleged that Harrah’s was negligent for overpolishing the marble floors. As a result of her fall, plaintiff sustained disc herniations in cervical and lumbar spine and a tear in her knee requiring surgery.
At the close of discovey, Colleen McClafferty moved for summary judgment arguing that plaintiff could not prove negligence as there was no evidence that Harrah’s polished the floor or treated the floor in an improper manner. Moreover, plaintiff could not make out a case without an expert. Judge Douglas Hurd agreed and granted Ms. McClafferty’s motion.
