Ubaydov v. Kenney’s Fleet Maintenance
In Ubaydov v. Kenney’s Fleet Maintenance, plaintiff Viacheslav Ubaydov alleged the our client, who was operating a large flat bed tow truck, struck his vehicle as he was driving on Van Dam Steet in Long Island City. Plaintiff allegedly sustained lower back and left ankle injuries. Prior to trial, Peter Lo Palo moved for summary judgment, arguing that Viacheslav Ubaydov’s injuries failed to meet the “serious injury threshold” as defined by Section 5102(d) of the Insurance Law of the State of New York. The Court agreed and dismissed Viacheslav Ubaydov’s complaint.
