Booker v. Bally’s Park Place, Inc.
In Booker, the plaintiff alleged that she tripped over rocks spilled from a large decorative planter at Wild Wild West Casino. As a result, she sustained a significant knee injury which totally disabled her.
At the close of discovery, Reena Shah moved for summary judgment arguing that there was no proof that Bally’s had actual or constructive notice of the spilled rocks. She also argued that this case was not a mode of operations case where notice is not required. Judge Hollar-Gregory agreed and granted Ms. Shah’s motion.
